Section 2523. Eligibility of service providers

Prenatal care service providers are eligible to participate in the prenatal care assistance program, if they satisfy the standards for providing services established by the commissioner pursuant to section twenty-five hundred twenty-two of this title, have not been disqualified from participation in the medical assistance program authorized by title eleven of article five of the social services law, agree to serve eligible service recipients and meet one of the following requirements: (a) a medical care facility certified pursuant to article twenty-eight or forty-four of this chapter which provides ambulatory prenatal care services; (b) a medical care facility certified pursuant to article twenty-eight or forty-four of this chapter whose operating certificates are pending amendment to include prenatal care services, contingent upon their receipt of such final certification; (c) agencies and facilities whose applications for establishment under article twenty-eight of this chapter are under review and contain provision for prenatal care services, contingent upon their receipt of such final certification; (d) a licensed physician practicing on an individual or group basis; or (e) a certified nurse midwife practicing on an individual or group basis.
