Section 45.05. Chair of commission

  • (a) The chair shall be the chief executive officer of the commission.
        (b)  The  chair  may  appoint such assistants, officers and employees,
      committees and consultants for the commission as may be determined to be
      necessary, prescribe their powers and duties, fix their compensation and
      provide for reimbursement of their expenses within amounts  appropriated
      therefor.
        (c)  The  chair  may, from time to time, create, abolish, transfer and
      consolidate bureaus and other units within the commission not  expressly
      established  by  law  as  may  be determined necessary for the efficient
      operation of the commission subject to the approval of the  director  of
      the budget.
        (d)  The  chair  may  request, and shall receive upon request from any
      department, division, board, bureau, commission or other agency  of  the
      state  or any political subdivision thereof or any public authority such
      assistance, information and data as will enable the commission  properly
      to carry out its functions, powers and duties.
        (e) The chair may request and upon such request the coroner, coroner's
      physician  or  medical  examiner  shall  provide  to the chair or to the
      mental hygiene medical review board, as designated, access  to  original
      autopsy  slides, tissue materials and specimens derived from any autopsy
      or inquiry with respect to the death of  a  patient  or  resident  in  a
      mental  hygiene  facility.  Such  original  materials shall be preserved
      intact, except for  unavoidable  changes  due  to  necessary  scientific
      testing by the mental hygiene medical review board and shall be returned
      to the coroner, coroner's physician or medical examiner.
