(a) As used herein: 1. "Local agency" shall mean a county governmental unit for a county not wholly within a city, and a city governmental unit for a city having a population of one million or more, designated by such county or city as responsible for substance abuse services in such county or city. 2. "Operating costs" shall mean expenditures, excluding capital costs and debt service, subject to the approval of the office, incurred for the maintenance and operation of substance abuse programs, including but not limited to expenditures for treatment, administration, personnel, contractual services, rental, depreciation and interest expenses incurred, in connection with the design, construction, acquisition, reconstruction, rehabilitation or improvement of a substance abuse program facility, and payments made to the facilities development corporation for substance abuse program facilities; provided that where the rent, financing or refinancing of the design, construction, acquisition, reconstruction, rehabilitation or improvement of a substance abuse program facility is through the facilities development corporation, operating costs shall include the debt service to be paid to amortize obligations, including principal and interest, issued by the New York State medical care facilities finance agency to finance or refinance the capital costs of such facilities. 3. "Debt service" shall mean amounts, subject to the approval of the office, as shall be required to be paid to amortize obligations including principal and interest issued by the New York state housing finance agency, the New York State medical care facilities finance agency or by or on behalf of a substance abuse program or a local agency to finance capital costs for substance abuse program facilities. 4. "Capital costs" shall mean expenditures, subject to the approval of the office, as shall be obligated to acquire, construct, reconstruct, rehabilitate or improve a substance abuse program facility.
