Section THREE. Hundred four of the civil practice law and rules shall not apply in this court

An  action  is  commenced  in  this  court  and
  jurisdiction  acquired  by service of a summons. A special proceeding is
  commenced and jurisdiction acquired by service of a notice  of  petition
