Section 97-RRR. School tax relief fund

  • 1. There is hereby established in
      the joint custody of the comptroller and the  commissioner  of  taxation
      and finance a special fund to be known as the school tax relief fund.
        2.  Such  fund  shall  consist  of  all monies credited or transferred
      thereto from the general fund or from any other fund or sources pursuant
      to law.
        3. The monies in such fund shall be appropriated for  school  property
      tax  exemptions  and  local property tax rebates granted pursuant to the
      real property tax law and the tax law and payable  pursuant  to  section
      thirty-six  hundred  nine of the education law, for payments to the city
      of New York pursuant  to  section  fifty-four-f  of  this  chapter,  and
      pursuant to section one hundred seventy-eight of the tax law.
        4.  All  payments from the fund shall be made on the audit and warrant
      of the comptroller on vouchers approved by the commissioner of the state
      education department.
        ** 5.  Notwithstanding  the  provisions   of   section   one   hundred
      seventy-one-a  of  the  tax  law, as separately amended by chapters four
      hundred eighty-one and four hundred eighty-four of the laws of  nineteen
      hundred  eighty-one,  or  any  other  provisions of law to the contrary,
      during the fiscal year beginning April first,  two  thousand  nine,  the
      state  comptroller  is  hereby authorized and directed to deposit to the
      fund created pursuant to this section from amounts collected pursuant to
      article twenty-two of the tax law and pursuant to a  schedule  submitted
      by the director of the budget, up to $3,524,450,000, as may be certified
      in  such schedule as necessary to meet the purposes of such fund for the
      fiscal year beginning April first, two thousand nine.

        ** 5.  Notwithstanding  the  provisions   of   section   one   hundred
      seventy-one-a  of  the  tax  law, as separately amended by chapters four
      hundred eighty-one and four hundred eighty-four of the laws of  nineteen
      hundred  eighty-one,  or  any  other  provisions of law to the contrary,
      during the fiscal year beginning April first, two  thousand  seven,  the
      state  comptroller  is  hereby authorized and directed to deposit to the
      fund created pursuant to this section from amounts collected pursuant to
      article twenty-two of the tax law and pursuant to a  schedule  submitted
      by the director of the budget, up to $4,888,000,000, as may be certified
      in  such schedule as necessary to meet the purposes of such fund for the
      fiscal year beginning April first, two thousand seven.

      during the fiscal year beginning April  first,  two  thousand  six,  the
      state  comptroller  is  hereby authorized and directed to deposit to the
      fund created pursuant to this section from amounts collected pursuant to
      article twenty-two of the tax law and pursuant to a  schedule  submitted
      by  the director of the budget to meet the purposes of such fund for the
      fiscal year beginning April first, two thousand six.
