Section 97-EE. New York Great Lakes protection fund

  • 1. There is hereby
      established in the joint  custody  of  the  state  comptroller  and  the
      commissioner of taxation and finance a fund to be known as the "New York
      Great  Lakes  protection  fund".  Such  fund  shall  consist of revenues
      received from the Great Lakes protection  fund  and  all  other  moneys,
      credited  or  transferred thereto from any other fund or source pursuant
      to law.
        2. Moneys of the New York Great Lakes protection fund, within  amounts
      appropriated  by  the  legislature, may be expended only for programs or
      grants to  supplement  existing  Great  Lakes  research  and  protection
      programs consistent with the purposes of the Great Lakes protection fund
      agreement including the following:
        (a)  Research  on the economic, environmental and human health effects
      of contamination in the Great Lakes;
        (b) The collection and analysis of data on the Great Lakes;
        (c)  The  development  of  new  or  improved   environmental   cleanup
      technologies applicable to the Great Lakes;
        (d) Research to assess the effectiveness of pollution control policies
      affecting the Great Lakes; and
        (e)  The  assessment  of the health of the Great Lakes fish, wildlife,
      waterfowl and other organisms.
        3. Moneys shall be paid out of the fund on the audit  and  warrant  of
      the   state  comptroller  on  vouchers  certified  or  approved  by  the
      commissioner of the department of  environmental  conservation,  as  the
      contract  administrator for the New York Great Lakes protection program,
      for which the  department  will  enter  into  contracts  with  qualified
      parties  to  carry  out  the  program submitted by the Great Lakes Basin
      advisory council.
        4. Any income earned on moneys in the New York Great Lakes  protection
      fund shall be added to and used for the purposes of such fund.
