Section 7. Proposals for department printing

  • 1. The several officers,
      institutions and departments of the state shall, as and when required by
      the commissioner, transmit to the commissioner an  estimate  in  writing
      showing  in detail all printing required for such office, institution or
      department and containing such information with regard thereto as  shall
      be  required  by  the  rules  and regulations of said commissioner. Said
      commissioner shall give notice to prospective bidders, that he will on a
      day named therein, receive  sealed  proposals  for  department  printing
      provided  to  be  furnished  under this chapter, pursuant to one or more
      contracts, in accordance with classifications made by the  commissioner,
      the  same  to be furnished as prescribed by law for the period specified
      in the proposal. Said commissioner shall prepare specifications for  all
      department  printing to be contracted for and shall invite all bids upon
      specifications, and shall let all contracts  upon  such  specifications,
      and  such  specifications  shall  be  a part of each said contract. Such
      specifications, when prepared, shall be filed  in  the  office  of  said
      commissioner  and  shall  be  open  to  inspection  at  all  times.  The
      commissioner may reject all bids submitted to him if in his opinion  the
      lowest bid is excessive.
        2.  The  specifications for such department printing must set forth in
      such detail as will adequately  inform  the  proposing  bidders  of  the
      nature,   kind,   quality   and   quantity   thereof.   Copies  of  such
      specifications shall be delivered to all bona fide applicants  therefor.
      The  said  specifications  shall  also  provide  that  the bidders shall
      present their proposals in detail, bidding upon the  several  items  set
      forth  in  the  specifications  and  shall  be  in accordance with those
      established pursuant to section one  hundred  sixty-four  of  the  state
      finance law.
        3.  At  the time when and at the place where bids are advertised to be
      received in the manner herein provided, the commissioner shall  publicly
      open the bids received and record them without any change, correction or
      addition whatever.
        4.  No  bids  shall be withdrawn or canceled, but the commissioner may
      reject any bids which do not conform to his rules and  regulations,  and
      may  reject  all  bids and again advertise for bids in the manner herein
      provided if in his opinion the interests of the state will  be  promoted
      thereby.
        5.  Every  bid received must be a sealed bid, and the commissioner may
      require adequate guaranty that bidder will enter into the contract if it
      shall be awarded to him. Notice of  the  requirement  of  such  guaranty
      shall  be embodied in the public notice of such letting, and such notice
      shall also require, and each contract shall provide, for the giving of a
      bond in such manner as the commissioner shall prescribe, conditioned for
      the faithful performance of the contract.
        6. Each contract when awarded shall be executed in duplicate  and  one
      duplicate  original  thereof  shall  be forthwith filed in the office of
      said commissioner and the other  duplicate  original  thereof,  together
      with  bond,  if required, accompanying said contract, shall be forthwith
      filed in the office of the comptroller of the state.
        7. Separate contracts may be made at any  time  for  any  article  not
      specifically mentioned in the contract or contracts.
