Section 2325. Houses of prostitution; injunction; withdrawal of complaint

  • 1. If the complaint in an action instituted pursuant to  the  provisions
      of  this article, is filed by any person or association, it shall not be
      dismissed except upon a sworn statement made by the complainant and  his
      attorney,  setting forth the reasons why the action should be dismissed,
      and the dismissal approved by the district attorney  in  writing  or  in
      open court.
        2.  If  the  judge  is  of  the  opinion that the action should not be
      dismissed, he may direct the district attorney to prosecute said  action
      to judgment, and if the action is continued more than one term of court,
      except  for  good cause shown, any citizen of the county or the district
      attorney may be substituted for the complaining party and prosecute said
      action to judgment.
