Section 41.27. State aid procedures

  • (a) State aid shall not be granted for capital costs unless:
        1.   appropriations  authorizing  them  have  been  requested  by  the
      commissioner;
        2. these appropriations have been recommended by  the  governor  in  a
      budget bill which specifies the facility to be acquired, constructed, or
      improved, the total estimated cost for each facility, and estimated date
      of completion; and
        3.  the budget bill has been approved by the legislature for the state
      fiscal year for which it was submitted.
        (b) Claims for state aid shall be  made  in  a  manner  and  on  forms
      prescribed  by  the  regulations  of  the  commissioner and shall be for
      expenditures or costs incurred in accordance  with  previously  approved
      state aid applications supported by specific budgets as required by this
      chapter.
        (c)  When  certified by the commissioner, state aid shall be paid upon
      the audit and warrant of the comptroller.
