Section 924-A. Town of North Hempstead industrial development agency

      the  benefit of the town of North Hempstead in the county of Nassau, and
      the inhabitants thereof, an industrial development agency, to  be  known
      as  the TOWN OF NORTH HEMPSTEAD INDUSTRIAL DEVELOPMENT AGENCY, is hereby
      established for the  accomplishment  of  any  or  all  of  the  purposes
      specified  in title one of article eighteen-A of this chapter.  It shall
      constitute a body corporate and politic, and be perpetual  in  duration.
      It  shall have the powers and duties now or hereafter conferred by title
      one of article eighteen-A of this chapter  upon  industrial  development
      agencies,  provided  that the exercise of the powers by such agency with
      respect to  the  acquisition  of  real  property  whether  by  purchase,
      condemnation  or  otherwise, shall be limited to the corporate limits of
      the town  of  North  Hempstead.  It  shall  be  organized  in  a  manner
      prescribed  by  and be subject to the provisions of title one of article
      eighteen-A of this chapter.  Its  members  shall  be  appointed  by  the
      governing  body  of the town of North Hempstead in the county of Nassau.
      The agency, its members, officers and employees, and its operations  and
      activities  shall in all respects be governed by the provisions of title
      one of article eighteen-A of this chapter.
        2. Any other provision of  law  notwithstanding,  the  town  of  North
      Hempstead  industrial  development  agency  may  not  participate in any
      commercial or industrial activity authorized by  title  one  of  article
      eighteen-A  of  this  chapter, except a recreational project designed to
      maintain open space and  assist  in  the  recharge  of  the  groundwater
      supply,  within a critical recharge area of the town of North Hempstead,
      which is defined as that area within hydrogeologic zone one of the  Long
      Island comprehensive waste treatment management plan of nineteen hundred
      seventy-eight  or  as  amended  and  adopted  by the commissioner of the
      department of environmental conservation. Provided further that the town
      of North Hempstead industrial development agency may not participate  in
      or  finance  any  facility  or  resource  recovery project to collect or
      dispose of hazardous waste as that term is defined in section 27-0901 of
      the environmental conservation law or contract with any person, firm, or
      corporation to operate any facility or resource recovery project for the
      collection or disposal of such hazardous waste except under order of the
      commissioner of the department of environmental conservation.
        3. The provisions of section eight hundred eighty-two of this  chapter
      shall not apply to the agency created by this section.
