Section 1059. Abandoned child

If the court finds that a child was abandoned by his parents or by the other person lawfully charged with his care, it may make an order so finding and may discharge the child to the custody of the commissioner of social services who shall provide for such child as in the case of a destitute child or as otherwise authorized by law. In such case the court shall direct the commissioner to institute a proceeding pursuant to section three hundred eighty-four-b of the social services law to legally free such child for adoption.
