Section 11-108. Penalties

1. Any person having been served with an order pursuant to the provisions of any local law or ordinance, or the procedures adopted pursuant to section three hundred eighty-one of the executive law for the administration and enforcement of the state uniform fire prevention and building construction code, who shall fail to comply with such order within thirty days after such service or within the time fixed by such order for compliance, whichever is greater, and any owner, builder, architect, engineer, contractor or subcontractor taking part or assisting in the construction or use of any building who shall knowingly violate any applicable provisions of the code or any lawful order of the governmental entity responsible for the administration and enforcement thereof shall be punishable by a fine of not more than five hundred dollars or by imprisonment of not more than thirty days in jail, or both. 2. Except as provided otherwise by law, any such violation shall not be a crime and the penalty or punishment imposed therefor shall not be deemed for any purpose a penal or criminal penalty or punishment, and shall not impose any disability upon or affect or impair the credibility as a witness, or otherwise, of any person convicted thereof.
