Section 192-D. Advisory council on petroleum product standards

  • 1. There is
      established an advisory council on petroleum product standards to advise
      and  make   recommendations   to   the   commissioner   concerning   the
      establishment  of  standards  for  petroleum  products  and  appropriate
      testing methodology therefor.
        2. The advisory council on petroleum product standards  shall  consist
      of  nine  members  appointed  by  the  commissioner,  selected for their
      experience and expertise. One member shall be a  representative  of  the
      department of taxation and finance, one member shall be a representative
      of  the  department of environmental conservation, one member shall be a
      representative of the consumer protection board, one member shall  be  a
      representative  of  the petroleum product distributors, one member shall
      be a representative of retail service stations and one member shall be a
      representative of the petroleum producers. The balance  of  the  council
      shall  be  comprised  of  representatives  of  government,  business  or
      institutions with an interest in  the  quality  of  petroleum  products.
      Members  shall  be  appointed  for  a term of five years and shall serve
      until their successors are chosen, provided,  however,  that  the  three
      representatives  of  industry  trade  associations first appointed shall
      serve for a two  year  term.  Members  shall  serve  without  salary  or
      reimbursement  except  for their ordinary and necessary travel expenses,
      but only if such members are not  otherwise  entitled  to  reimbursement
      from other government sources.  The members of the council shall elect a
      chairman by majority vote.
        3.  The  duties  and  responsibilities  of  the  advisory  council  on
      petroleum product  standards  shall  be  limited  to  providing  advice,
      comments and recommendations to the commissioner in regard to:
        (a) the establishment or revision of standards for petroleum products;
        (b)  the  establishment or revision of appropriate testing methodology
      concerning petroleum product standards, composition and quality;
        (c) the collection of information  relative  to  compliance  with  the
      requirements  of  this  article  insofar  as  it  pertains  to  sale  or
      distribution of petroleum products;
        (d) the effective implementation of the requirements of  this  article
      relating to petroleum products; and
        (e)  the  adoption  and  revision  of  rules  and  regulations  of the
      department relating to petroleum products.
