In the event that the adjudication of the
  violation   underlying   the   seizure  is  not  held  at  OATH,  and  a
  determination is made that the  vehicle  and  tools  were  not  used  in
  connection  with  unlicensed  or  unregistered  activity, the department
  shall promptly release such vehicle and/or tools.
